Building Your Export Compliance Program

The key to remaining compliant over time is to create a strong foundation of Export Compliance within your business. We have found the best way to do this is to have a strong Export Compliance Program (ECP). An ECP is a guide of rules and procedures specifically created for your business. We assist you in creating it, fitting the program with procedures for your specific needs as well as necessary standards required by the government.

It has been our experience that if the government is scrutinizing your business for any compliance failings, having a strong ECP that you follow goes a long way to convincing them of your commitment to the law and our country’s security. The ECP will commit you to daily practical safety standards such as cyber security practices and visitor sign-in sheets as well as long-term actions such as periodic audits of your ECP.

Classifying Your Controlled Products

Perhaps the most important step in your business remaining compliant with U.S. regulations is the accurate classification of your products. Classification determines the level of control on your product, which in turn affects your ability to obtain licenses and the countries you are allowed to do business with. If your technology is improperly classified, you might be providing critical technology to countries the U.S. government has determined to not be responsible enough to obtain. This is why classification is the main focus for many companies, as it should be.
